1. Acceptance of Terms
By accessing this website, requesting a quote, signing a proposal, or engaging All American Fence (“Company,” “we,” “us,” or “our”) for services, you agree to these Terms of Service. If you do not agree, do not use our website or services.
No oral statements, representations, or prior discussions shall modify these Terms unless confirmed in writing and signed by the Company.
2. Scope of Services
We provide residential and commercial fencing services including installation, repairs, gate systems, access control systems, and related services as defined in a written, signed proposal.
Only the work specifically described in the signed proposal is included in the contract scope. Any additional work requested by the customer constitutes a change order and may require additional payment and revised scheduling.
3. Estimates, Change Orders & Pricing
Estimates are based on visible site conditions and information provided at the time of evaluation.
Final pricing may change due to:
- Unforeseen site conditions
- Hidden obstructions (rock, concrete, buried debris, unmarked utilities)
- Grade changes
- Permit requirements
- Material cost fluctuations
- Customer-requested modifications
All change orders must be approved in writing before additional work proceeds.
4. Payment Terms
Payment terms are outlined in the signed proposal and may include:
- Non-refundable deposit
- Progress payments
- Final payment upon substantial completion
Failure to remit payment may result in:
- Suspension of work
- Removal of materials (where legally permitted)
- Delay of scheduling
- Late fees as permitted by Michigan law
Customer agrees to pay all reasonable costs of collection, including attorney fees, court costs, and interest, in the event of non-payment.
5. Construction Liens
In accordance with Michigan's Construction Lien Act (MCL 570.1101 et seq.), All American Fence reserves the right to file a construction lien for unpaid labor, materials, or services on eligible projects.
Failure to pay may result in a lien being placed against the property until the account is satisfied in full.
6. Permits, Property Lines & Approvals
Unless explicitly stated in writing:
- The property owner is responsible for verifying property boundaries.
- The property owner is responsible for obtaining HOA approval.
- The property owner is responsible for required permits.
We are not responsible for boundary disputes, zoning violations, or regulatory issues arising from inaccurate information provided by the customer.
7. Site Conditions & Access
Customer agrees to:
- Provide safe and reasonable access to work areas
- Remove personal property from installation zones
- Identify and disclose all private underground systems
We are not responsible for damage to:
- Unmarked private utilities
- Sprinkler systems
- Septic systems
- Landscaping within installation areas
- Hidden or concealed conditions
8. Scheduling & Force Majeure
Project timelines are estimates only and may be affected by:
- Weather
- Supply chain disruptions
- Permit delays
- Labor shortages
- Acts of God
- Government actions
We are not liable for delays beyond our reasonable control.
9. Warranties & Limitations
Manufacturer warranties apply where available and are governed solely by the manufacturer’s terms.
Workmanship warranty, if offered, is defined in the signed proposal.
Warranty exclusions include:
- Normal wear and tear
- Rust or corrosion from environmental exposure
- Impact damage
- Improper use or modification
- Alterations by third parties
- Acts of nature
- Failure to maintain
Warranty is void if the installed system is altered or serviced by unauthorized parties.
10. Financing & Third-Party Services
Financing options (including through Enhancify or other lenders), access control platforms, automation systems, quoting/estimator tools (including MySalesman), and third-party integrations are subject to separate agreements with those providers.
All American Fence is not responsible for:
- Financing approvals or denials
- Interest rates
- Third-party system outages
- Software malfunctions
- Policy changes by third-party providers
Customers agree to comply with all third-party terms.
11. Limitation of Liability
To the fullest extent permitted by law:
- Our total liability is limited to the contract value of the services performed.
- We are not liable for indirect, incidental, special, or consequential damages.
- We are not responsible for loss of business, revenue, or operational interruption.
Under no circumstances shall liability exceed the amount paid to the Company for the specific project.
12. Indemnification
Customer agrees to indemnify and hold harmless All American Fence, its owners, employees, and subcontractors from any claims, damages, losses, or expenses arising out of:
- Inaccurate property boundary information
- Failure to obtain required approvals
- Misuse of installed systems
- Customer modifications
13. Dispute Resolution
In the event of a dispute:
1. The parties agree to attempt informal resolution first.
2. If unresolved, disputes shall be submitted to binding arbitration in the State of Michigan.
Customer waives the right to participate in class action claims against the Company.
All disputes shall be governed by Michigan law.
14. Cancellations
Cancellation terms are governed by the signed proposal.
Deposits may be non-refundable once:
- Materials are ordered
- Fabrication has begun
- Scheduling is confirmed
15. Website Use
All website content is property of All American Fence and may not be copied or distributed without written consent.
Users agree not to:
- Attempt unauthorized access
- Interfere with site functionality
- Submit fraudulent or misleading information
16. Modifications to Terms
We reserve the right to update these Terms at any time. Continued use of our services constitutes acceptance of revisions.
